Childhood Obesity: An American Epidemic America is facing a serious challenge! Children’s health is becoming a critical concern. Childhood obesity has become an â€Å"epidemic disease† that has rapidly grown over the years in the United States. According to the National Center for Health Statistics in 2011 states that, â€Å"childhood obesity has more than doubled in children and quadrupled in adolescents in the past 30 years. The acceptance has to be unequivocal, clear and unambiguous. In context of acceptance, it is crucial that the acceptance is given in the mode which had been prescribed by the offering party. The acceptance date is taken to be such date when the acceptance is communicated to the offering party; in other words, the day on which the acceptance reaches the offering party, is the date of acceptance (Blum, 2007). In Hadley v Baxendale [1854] EWHC Exch J70, it was provided that the damages for the contract breach would be provided only when it was a reasonable and fair result from contravention of the contract or in such cases where the damages could be reasonably be supposed to be contemplated of both parties during the time of formation of contract. Lastly, the defendants had the duty of mitigating the loss. In Payzu v Saunders [1919] 2 KB 581, the damages were not awarded to the claimant as he had been provided with the opportunity of purchasing the item at discounted p rice. As against this, Cohen v Roche [1927] 1 KB 169 saw a furniture shop being owned by the claimant and him entering in an agreement of purchasing a certain number of Hepplewhite chairs for selling this in his shop. The defendant refused to deliver these chairs, resulting in the contract being breached. This led to the plaintiff brining in a case of breach of contract against the defendant and claimed for specific performance from the court. However, this request was denied and the monetary compensation was seen as an adequate compensation in this case. The reason for this was that the chairs were deemed as goods of ordinary nature having no special interest or value. In the present instance, a contract had been drawn between Adam and Edwin where Adam was set to purchase the vintage car, 1925 Rolls Royce from Edwin for a price of $500,000. They even entered in a contract for this very purpose. However, Edwin later on denied selling the vintage car to Adam as he knew from grapevine that the same car could be sold for $700,000 to an Arabian Sheik. Here, Adam can apply for damages for the breach of contract on part of Edwin. Development of Conflict between Members of a Small Team and the Measures Taken To Solve the Impasse - Essay Example This paper illustrates that a recent experience that forms the main basis of this reflection forms the researcher’s experience of a workplace conflict in a team of four and the associated measures the author had to take to intervene in the situation being the supervisor. Mr. Michael, a new employee at the company, was recently transferred from another branch to the environmental department of that comprised of three members of staff and the researcher, as the supervisor in the department. Mr. Michael was African and as the author would later discover his arrival resulted in tension and misunderstanding in the department. Mr. Moses, the department long-serving officer was involved in a heated discussion with Michael on the jobs allocated to Mr. Michael that turned out to be more than the other two were given and in the process, Moses used a racial slur. Mr. Michael believed that the other members of the department were in a collision since they did not agree to share work equal ly resulting in hostility developing into workplace conflict among the four members of the department. Mr. Moses and the other department members believed that they were superior having only interacted with department members of the same color since Mr. Michael was the first employee in the company of a different ethnic community. In hindsight, it has come to my view that the author could have taken different measures that could have resulted in a better solution to the situation. After the confrontation, the work environment was edgy and filled with anxiety that no work was being completed successfully owing to the no-talking terms between Mr. Michael and the other members of the department including Mr. Moses. After meetings with the department members and one-on-one conversation with Mr. Michael and Mr. Moses to help resolve the situation to no avail, the author felt that he need to step in and solve the issue for the benefit of the organization and the success of the department. Since the department was running well before Mr. Michael’s arrival, the author requested his transfer, which he previously requested when the discrimination occurred since he believed he could not effectively work with the team. On reflecting on the solution, the author believes it was not morally correct to have undertaken that decision.
